What To Expect When You Work with Casey Cox Law Office

My goal is always to win a case as quickly as possible, not to prolong a case to get a larger backpay so my fee can be larger. I find that to be unethical and poor lawyering. I will even take cases that I know I will not get paid on, on a “pro bono” basis, because I enjoy helping people and I believe in holding SSA accountable – I take several of these each year.

Step 1.

Initial Consultation Over the Phone

Casey Cox Law Offices takes clients located in any U.S. state or territory, because everything can be done by phone/email/fax/mail, but I meet local clients in person when necessary and will even stop by and meet out-of-state clients when I’m in their town for hearings.

The first step will be discussing your case together and making sure I fully understand your situation. These calls can take anywhere from 10-30 minutes, depending on the complexity; but I am a firm believer that there is never too much information, so we will take as much or as little time as necessary to ensure things start off on the right foot.

Step 2.

Representation forms and paperwork

After we agree to work together, you will be mailed a small packet of paperwork to fill out and return to me within a few days upon receiving it. I will file all of the required forms with SSA and they will then recognize me as your attorney and begin dealing with me as well. If you get overwhelmed by paperwork, I will always take the time to assist you, just call me.

Step 3.

Case review and filing of claim and/or appeal

If you need a claim or appeal filed, I will be sure to get those filed before deadlines. You do not need to worry about that, I have you covered. I will review your case and make sure we get all necessary evidence added to your claim file, and I often think outside the box and get creative in this area.

Step 4.

The stages of a disability claim

  • Stage One: When filing a brand new claim, called the “Initial level,” it can take 4-6 months for an answer on average, although in rare circumstances cases can get decided sooner or later than this depending on whether SSA needs to send you out for doctor exams. There is a lot of communicating between the attorney’s office and SSA and DDS during this stage, and I ensure my clients stay informed, get paperwork turned in, get exams scheduled, etc. A lot happens during this stage, so it is helpful to have an attorney early on in the process.

  • Stage Two: The first appeal, called “Reconsideration level,” usually takes 2-4 months to get a new decision back. SSA has a new decision-maker look at your case to see if they agree with the denial, and this is our chance to submit new evidence.

  • Stage Three: If denied twice, which most people are, then the “Request For Hearing” appeal is made, and it will take 11-13 additional months on average before your hearing. This is where I will represent you before a judge and we have the best chance of success.

  • Stages Four and Five: If denied by the judge, I will take your case on appeal to the Appeals Council and further on to Federal District Court, if necessary, if I find legal basis for doing so. Many people give up at stage four, but I will not quit fighting for a case if it is a well-supported case for disability. As long as my client is willing to hang in there, I will, too.
